Viresh Fernando the founding principal of Viresh Immigration Law is a proud graduate of Royal Primary School and Royal College, Colombo, Sri Lanka. Viresh migrated to Canada in 1973 and two months later moved to Rochester, New York, where on a full scholarship, Viresh completed a degree in economics from the University of Rochester. After completing this first of his many degrees and professional designations, Viresh returned to Toronto where he joined a leading Canadian Chartered Accounting firm. Viresh passed out as a Chartered Accountant in 1983 and immediately started his own firm.Viresh, then attended McGill University in Montreal where he completed a Bachelor of Law Degree and joined the Attorney General of Canada and the department of Justice to complete his Articles. If we find that any information or document provided to us is in any way inaccurate, false, misleading, we maintain the right to terminate the retainer agreement and to inform Immigration Canada (IRCC). All monies paid will be forfeited, and any balance due shall be remitted by the client within 7 days.

    STUDENT IMMIGRATION - FAQ

    Always apply very early given that processing times vary and visa offices are inundated with a high volume of applications in the months just prior to start of school (terms or semesters typically start in September and January). The Student Direct Stream takes approximately 20 days but regular processing can be several months.

    Study Permits typically last a few months beyond the expected graduation date though they will be limited to when your passport expires. Note that the ability to study in Canada is governed by the Study Permit itself, not the visa which takes up a page in your passport.

    If you wish to continue studying, you must apply for a study permit extension prior to the expiry of your current study permit. If you wish to work after graduation, we can assist you with a post graduate work permit (PGWP) for a reasonable fee and we highly recommend you retain us.  We are aware of hundreds of students over the years who made mistakes when applying for the PGWP, putting in jeopardy their path to PermanentRresidence after spending tens of thousands of dollars on their education in Canada.

    Work Permit - FAQ

    Work permits have varying lengths of validity as per the particular program used and also you may not have received full validity due to your passport expiring. 

    There are many types of work permits available which allow you to avoid having to get approval from the Department of Labour first (a Labour Market Impact Assessment), although sometimes this first step is required. Each program has differing requirements and legal strategy is often involved in terms of providing proper legal submissions and supporting documentation and even advising as to which border to enter Canada.

    There are many different types of work permits and some leave little room for refusals if done properly whereas others require strong submissions and evidence to cover all the possible ways to reject the application given there is more room for officer discretion.

    YES!  Obtaining a LMIA is a very complex procedure.  IRCC is extremely strict as to the content of advertisements; interviews are conducted by officers who will ask open-ended questions which if answered without guidance, can lead to a refusal - even where there is a genuine need for the foreign worker. We can assist employers and employees to avoid the pitfalls.
